End User License Agreement for the WealthDaily Application

This End User License Agreement ("Agreement") is a binding agreement between you ("End User" or "you") and TL Leconte LLC ("Company," "we," or "us"). This Agreement governs your use of the WealthDaily application (including all related documentation, the "Application"). The Application is licensed, not sold, to you.
BY DOWNLOADING, INSTALLING, OR USING THE APPLICATION, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE APPLICATION.
The Application
WealthDaily is a mobile application designed to help users build better financial habits through daily challenges, progress tracking, streak monitoring, and goal-setting tools. The Application is designed for use on mobile devices running compatible operating systems.

Scope of License
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your personal, non-commercial purposes on a single mobile device owned or controlled by you.
You shall NOT:
Technical Requirements
The Application requires a compatible mobile device and operating system. You acknowledge that it is your responsibility to ensure that your device meets the minimum requirements.
iOS
Requires iOS 14.0 or later. Compatible with iPhone.
Android
Requires Android 8.0 or later.
The Application also requires an active internet connection for certain features, including account synchronization, subscription management, and cloud backups.
Maintenance and Support
TL Leconte LLC is solely responsible for providing maintenance and support services for the Application, as specified in this Agreement or as required under applicable law.
Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
Use of Data
You acknowledge that we may collect and use technical data and related information, including but not limited to technical information about your device, system, and application software, to facilitate updates, product support, and other services.
Privacy First
We use this information to improve the Application and provide services to you. Please review our Privacy Policy for full details on how we handle your data.
User-Generated Contributions
The Application may allow you to create, submit, post, display, or store content and materials, including but not limited to activity logs, challenge entries, notes, and other content ("Contributions").
You represent and warrant that:
Contribution License
By submitting Contributions to the Application, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to:
This license is for the limited purpose of operating, developing, providing, and improving the Application and our services.
Liability

WealthDaily provides tools for tracking financial habits and challenges. We do NOT provide financial, investment, tax, or legal advice. Always consult with qualified professionals for financial decisions.
To the fullest extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Application.
Warranty
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
Product Claims
TL Leconte LLC, not Apple or Google, is responsible for addressing any claims you or any third party may have relating to the Application or your possession and/or use of the Application, including but not limited to:
Legal Compliance
You represent and warrant that:
Location
You are not located in a country subject to a U.S. Government embargo or designated as a 'terrorist supporting' country
Sanctions
You are not listed on any U.S. Government list of prohibited or restricted parties
Compliance
You will comply with all applicable local, state, national, and international laws and regulations

This Agreement is effective until terminated by you or us. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms.
Upon Termination:
- You must cease all use of the Application
- You must delete all copies of the Application from your devices
- All provisions that should survive termination will remain in effect
We may also terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever.
Third-Party Terms and Beneficiaries
The Application may rely on third-party services, content, and software. You agree to comply with any applicable third-party terms when using the Application.
Apple
Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance, Apple has the right to enforce this Agreement against you.
Google Play's terms of service apply to your use of the Application on Android devices.
Apple and Google have no obligation to furnish any maintenance or support services for the Application.
Intellectual Property Rights
The Application, including all content, features, and functionality, is owned by TL Leconte LLC and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
In the event of any third-party claim that the Application infringes intellectual property rights, TL Leconte LLC will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
Applicable Law
This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
Any legal action or proceeding arising under this Agreement will be brought exclusively in the federal or state courts located in Delaware, and the parties hereby consent to personal jurisdiction and venue therein.
Miscellaneous
Entire Agreement
This Agreement constitutes the entire agreement between you and us regarding the Application and supersedes all prior agreements.
Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver
Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights.
Assignment
You may not assign or transfer this Agreement without our prior written consent. We may assign our rights and obligations without restriction.
Amendments
We reserve the right to modify this Agreement at any time. We will notify you of material changes by posting the updated Agreement in the Application.
By downloading, installing, or using WealthDaily, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement.
